Mock Trial for Health and Safety Offences and Corporate Manslaughter
The sessions involved
Introduction – a welcome and introduction to the court and trial process. This is combined with a discussion of the materials provided to delegates including an explanation of the relevant law, sheets to complete in their role as jury members, and an overview of the case that they will judge.
Trial – the trial includes both prosecution and defence cases, with witnesses called for both sides, and a summing up by the Judge.
Interactive Experience – in addition to asking delegates to discuss the evidence in groups at the end of the trial and reach their verdicts, they will also be invited to consider what they believe to be an appropriate sentence in the event of a conviction. Delegates will be taken through the Sentencing Guidelines for health and safety offences and then asked to take on the role of judge to agree a sentence based on the guidelines.
The session will leave delegates feeling empowered to effect positive change in the way that they work as a health and safety professionals or as managers and supervisors.
The presenters were Matthew Breakell (Partner) and Stefan Desbordes (Solicitor) ofDAC Beachcroft, who are lawyers specialising in advising in relation to corporate criminal investigations and defending prosecutions brought by regulatory agencies such as the Health and Safety Executive, Local Authorities, the Environment Agency, Natural Resources Wales and the Police. They have advised and represented Plc and FTSE 100 companies, as well as SMEs and individuals.
Our costs were very competitive with free parking at the stadium and the seminar includes refreshments and lunch.
